Terms and conditions for the Izy App

These terms and conditions govern your use of the mobile application («IZY App») offered by Izy AS («Izy», «us», «we», or «our»). More information about the IZY App can be found at https://izy.no/. 

The terms and processing of personal data may vary depending on the services of the IZY App you wish to utilize. Where the terms for a specific service differ from these standard terms, it will be separately described for each service. The privacy statement can be found here.

By accessing or using the IZY App, you agree to these terms.

Purpose

The IZY App is a tool for communication and services in modern buildings. It facilitates access to information about the building and its facilities, offers on goods or services, and allows for bookings and purchases from providers in the building and other associated providers. Note that Izy is not a party to any agreement made when you book or purchase something and is not responsible for its fulfillment.

Users may choose to utilize location services to make certain services in the IZY App more efficient and precise, as specified where applicable.

Purchases

If you wish to purchase a product or service offered through the IZY App («Purchase»), you may be required to provide certain information relevant to your purchase, including your credit card number, the expiration date of your card, billing address, and delivery information. Such information will only be shared with third parties, such as payment processors and suppliers, to facilitate the completion of the purchase.

Availability, Errors, and Inaccuracies

We continuously update our offerings of products and services available through the IZY App. The products or services available through the IZY App may be mispriced, inaccurately described, or unavailable, and we may experience delays in updating information on the IZY App.

We do not independently verify information provided by third parties, such as suppliers, property managers, or landlords, through the IZY App.

We do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

User account, Guest user

If you have an employer who wants you to pay for cafeteria food through the IZY App and receive other building-related information, we have received your full name and email from your employer and other information to create you as a user. If you do not activate a user account, this information will be deleted and not used for anything. 

The IZY App can also be used by individuals who do not work in the building, either as a voluntarily registered user or as a guest.

You always have the option to choose which services of the IZY App you wish to use, but not all functionalities are available to guests. Some employers require that cafeteria food is paid for through the app, which cannot be opted out of. If the employer offers discounted rates in the cafeteria for its employees, these rates can only be used by approved registered users for whom the employer pays a cafeteria contribution. 

When you create a user account with us, you must provide us with accurate and up-to-date information. 

If you register as an employee of an employer in the building, we may need to contact you. To ensure that your account is linked to you and no one else, and to prevent infringements of others’ rights, it’s important that you use the email address provided by your employer when registering a user and when contacting us. 

You are responsible for protecting the password you use to access the IZY App and for any activities or actions under your password. You should not share your password with any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Security

We strive to make the service a safe place for all users. However, we cannot guarantee this. Therefore, your contribution is essential. By using the service, you agree to comply with these terms, including all other guidelines Izy makes available to maintain security in the Izy Portal.

If you fail to comply, we reserve the right to remove all offensive content, terminate or restrict access to your account, and notify third parties, including law enforcement authorities – and provide authorities with information related to your account. This step may be necessary to protect the security of our users and others, to investigate, resolve, and enforce potential breaches of terms, and to detect and resolve any concerns related to fraud or security.

Izy must be immediately notified of any malicious activity or other activity that deviates from the norm.

Copyright

The IZY App and its original content, features, and functionality remain the exclusive property of Izy and its licensors or other collaborating third parties. The IZY App and content delivered through it are protected by copyright, trademarks, and other laws in Norway and abroad. Our or our licensors’ or collaborating third parties’ trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Izy.

Links to other websites

The IZY App may contain links to third-party websites, apps, or services not owned or controlled by Izy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Furthermore, you agree that Izy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party sites or services you visit.

Privacy

To deliver the IZY App and its functionalities, we must process certain personal data about our app users. IZY acts as a data processor on behalf of employers, landlords, and others who want us to add users to the IZY App and for businesses offering their products and services in the app. For cases where IZY acts as a data processor for such parties, data processing agreements are made that cover the customer relationship and describe our processing of personal data on behalf of the customer.

IZY also processes personal data for its purposes, including aggregating and anonymizing data to gain insights that can help identify errors, improve, and develop the IZY App, and to compile statistics and analysis. Termination

You can terminate your license to the IZY App by sending a message to info@izy.no. You can also terminate your license by ceasing to use the IZY App, after which your personal data will be deleted after 90 days. We may terminate your license to the whole or parts of the IZY App without notice or liability.

Limitation of Liability

Under no circumstances shall Izy, its directors, employees, or suppliers be liable for any direct or indirect losses, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, or claims from third parties resulting from your access to or use of or inability to access or use the IZY App; any conduct or content of any third party on the IZY App; any content obtained from the IZY App; and unauthorized access, use, or alteration of your transmissions or content, whether or not we have been informed of the possibility of such damage, or even if the IZY App does not fulfill its essential purpose.

The total liability of IZY related to the IZY App, breach of these terms, or negligence, is limited to NOK 10,000.

Disclaimer

Your use of the IZY App is at your own risk. The IZY App is provided on an «AS IS» and «AS AVAILABLE» basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Izy, its subsidiaries, affiliates, and its licensors and suppliers do not warrant that 

1. a) the IZY App will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; 
2. c) the IZY App is free of viruses or other harmful components; or 
3. d) the results of using the IZY App will meet your requirements.

Governing Law

These terms shall be governed and construed in accordance with Norwegian law, regardless of possible conflict of law between Norwegian and foreign law and regulations. provisions would indicate otherwise.

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between us regarding our service and supersede and replace any prior agreements we might have between us regarding the service.

Changes

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material or reduces your rights, we will provide at least 14 days’ notice before any new terms take effect. By continuing to access or use the IZY App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
