These terms and conditions (the “Terms”) apply to the use of Izy Prediction (the “Service”), provided by Izy AS (org. no. 922 177 775) (“Izy”, “us”, “we” or “our”). Izy Prediction is a forecasting platform based on artificial intelligence and machine learning, providing decision support for planning, resource management and operational monitoring. The Service forms part of Izy’s service offering and may also be integrated with other parts of the Izy platform where this has been activated by the Organisation. Further information about the Service is available at izy.no.
Depending on which offerings are used through the Service, the terms and the processing of personal data may vary. Where the terms for a specific offering deviate from these Terms, this will be stated separately for the relevant offering. The Privacy Policy is available here.
By using the Service, whether as a registered user or administrator, you (the “User”) accept these Terms. “Organisation” means the employer, building owner or other legal entity that has made the Service available to you and that has the right to manage users, access rights and content within the Service. These Terms are supplemented by Izy’s Privacy Policy and any specific terms agreed between Izy and the Organisation. In the event of conflict between such specific terms and these Terms, the specific terms shall prevail.
The Service analyses historical data in combination with relevant external factors, including weather data, seasonal variations and local activity information, and generates predictive insights relating to demand, activity, staffing and resource utilisation. The Service’s analytical results are not binding and do not replace independent professional, commercial or managerial assessments.
Unless otherwise specifically agreed, the Service may comprise the following modules:
Izy reserves the right to amend, further develop, replace or remove functionality within the framework of the applicable contractual arrangements. The limitation of liability in these Terms applies equally to pilot features, unless otherwise expressly agreed.
Predictions and analytical results may be based on, amongst other things:
Izy reserves the right to amend, supplement or adjust the data sources when this is deemed necessary or expedient to improve the Service’s functionality, accuracy, security or relevance.
The Service may be used as a standalone solution or in combination with other products and services from Izy. Where the Organisation already uses other Izy solutions, relevant data sources may be fully or partially integrated with the Service.
Prediction reports are made available at the frequency determined by the Service’s prevailing functionality or any specific agreement. The availability of reports is contingent upon Izy having received the necessary and sufficiently quality-assured data within the relevant deadlines.
Predictions, estimates and other analytical results generated through the Service constitute decision support only and are not binding. Izy provides no warranties regarding future results, actual demand, resource requirements, financial outcomes or other specific business results.
The Organisation and the User bear full responsibility for assessing the relevance, quality and applicability of the Service’s analytical results, including for obtaining the necessary professional, technical, financial or legal advice before making material decisions.
The Service’s forecasts are based on historical data, user-provided information and external data sources. The precision of the forecasts may be affected by circumstances beyond Izy’s control, including data quality, seasonal variations, extraordinary weather conditions, operational deviations and other unforeseen circumstances. Information regarding expected or historical accuracy is indicative and does not constitute warranties or binding performance obligations, unless otherwise expressly stated in a separate written agreement.
Where sufficient historical data or data quality is not available for a given location or use case, the Service’s precision may be reduced or the Service may be unavailable for the relevant purpose.
The Service uses methods based on artificial intelligence. Izy and the Organisation are each separately responsible for complying with applicable regulations on artificial intelligence, including Regulation (EU) 2024/1689 (the AI Act) to the extent the regulation has been implemented as EEA law and is binding on the relevant legal entity. This responsibility applies within the parties’ respective roles as provider and user of the AI system.
Izy endeavours to ensure that the Service is available and functions in accordance with the description of the Service. The Service may from time to time be wholly or partially unavailable due to maintenance, updates, errors, security incidents, capacity constraints or circumstances beyond Izy’s control. Izy may at any time amend, update, correct or remove information, functionality or technical components of the Service where this is objectively justified, including for reasons of operations, security, further development, legislative changes or regulatory requirements.
Access to the Service is granted to the Organisation and the Users authorised by the Organisation. Izy may create one or more administrator accounts based on contact information received from the Organisation. The Organisation is responsible for ensuring that information provided to Izy in connection with account creation is correct, complete and up to date. The Organisation is further responsible for appointing relevant administrators and for ensuring that roles and access rights are managed prudently and in accordance with the principle of least privilege.
The User shall use the email address or other identifiers approved by the Organisation for access to the Service. If an account is not activated within a reasonable time, Izy may delete the account and associated information.
Each User shall use the Service in accordance with these Terms, the Organisation’s instructions and applicable law. The User is responsible for protecting their own login credentials and preventing unauthorised use of the account. Passwords and other access information shall not be made available to unauthorised persons. The User shall notify the Organisation and/or Izy without undue delay upon suspecting a security breach, misuse or unauthorised access. The Service shall not be used for unlawful, misleading, offensive or unauthorised purposes, or in a manner that may damage, disrupt or impair the Service’s functionality, security or integrity.
The Organisation is responsible for ensuring that the Organisation’s and the Users’ use of the Service is in accordance with these Terms, any specific agreement with Izy, applicable law and the Organisation’s own internal policies.
The Organisation shall in particular ensure that:
Access rights that are no longer necessary shall be deactivated without undue delay. The Organisation is further responsible for assessing whether and how analytical results from the Service shall be used, and for ensuring that such use does not contravene law or agreement.
Izy endeavours to maintain a safe and secure service environment for all users. However, Izy cannot guarantee complete security. The User’s participation is of material importance to the security of the Service. By using the Service, the User undertakes at all times to comply with these Terms, including any additional guidelines that Izy makes available to safeguard the security of the Service.
If these Terms or other security-related guidelines are not complied with, Izy reserves the right to remove offensive or improper content, terminate or restrict access to the user account, and notify third parties, including law enforcement authorities, and disclose information relating to the account where this is deemed necessary. Such measures may be necessary to protect the safety of users and others, to investigate, remedy and enforce potential breaches of the Terms, and to detect and address matters relating to fraud or security.
In the event of malicious activity, or other activity deviating from normal use, Izy shall be notified without undue delay.
The Service, including its original content, features and functionality, is and shall remain the exclusive property of Izy, its licensors or other collaborating third parties. The Service and content conveyed through the Service are protected by copyright, trademark rights and other intellectual property rules in Norway and abroad. The trademarks, distinctive signs and other intellectual property rights of Izy, its licensors and collaborating third parties may not be used in connection with products or services without prior written consent from Izy. The Organisation and the User are granted a limited, non-exclusive, non-transferable and revocable right to use the Service in accordance with these Terms.
The Organisation and the User shall not, unless otherwise required by mandatory law or with express written consent from Izy:
Izy may use third-party suppliers for operations, development, storage, analysis, user support and other purposes related to the Service. Such subcontractors shall, to the relevant extent, be subject to agreements and instructions that satisfy the requirements of applicable data protection legislation. Izy is not liable for errors, delays, interruptions or losses directly caused by circumstances at third-party suppliers beyond Izy’s reasonable control, unless otherwise required by mandatory law or a separate written agreement.
Where the Service uses third-party solutions, the third-party supplier’s terms and privacy rules apply to the part of the service delivery provided by the third party. Izy is not a party to agreements entered into directly between the Organisation or the User and such third party, unless otherwise expressly agreed.
Izy processes personal data in connection with the Service to the extent necessary to deliver, administer, secure and further develop the Service. Where Izy processes personal data on behalf of the Organisation, Izy acts as data processor and the Organisation as data controller, in accordance with applicable data protection legislation and the data processing agreement. Further information about the processing of personal data is set out in the applicable Privacy Policy and data processing agreement.
Izy may use anonymised and aggregated data that cannot be linked to the Organisation, the User or individuals, for development, testing, analysis and improvement of the Service. Such data are not regarded as the Organisation’s confidential information and may be used by Izy also after the termination of the contractual relationship.
Izy may wholly or partially suspend the Organisation’s or the User’s access to the Service where this is objectively justified, including in the event of breach of these Terms, security risks, suspicion of misuse or failure to comply with applicable law.
The Organisation may terminate the contractual relationship in accordance with any specific agreement with Izy. Individual Users may request deactivation of their own account, but this does not in itself constitute termination of the Organisation’s contractual relationship with Izy. Upon termination, personal data may be deleted, anonymised or returned in accordance with applicable contractual arrangements, the Privacy Policy and legal obligations.
Izy, its representatives or suppliers shall under no circumstances be liable for direct or indirect losses, including loss of profit, data, use, goodwill or other intangible losses, or for claims from third parties arising from (i) your access to or use of, or inability to access or use, the Service, (ii) the conduct of third parties or content conveyed through the Service, (iii) content obtained from the Service, or (iv) unauthorised access to, use of or alteration of transmissions or content, regardless of whether Izy has been made aware of the possibility of such damage, and even if the Service fails to fulfil its fundamental purpose.
Izy's aggregate liability in connection with the Service, breach of the Terms of Use or negligence, is limited to NOK 10,000.
Use of the Service is at the User’s own risk. The Service is provided “as is” and “as available”. The Service is delivered without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or satisfactory quality.
Izy, its subsidiaries, affiliated companies, licensors and suppliers do not warrant that
a) the Service will operate uninterrupted, securely or be available at a particular time or location;
b) any errors or defects will be corrected;
c) the Service is free from viruses or other harmful components; or
d) the results of use of the Service will meet the User’s requirements.
These Terms are governed by and shall be construed in accordance with Norwegian law, without regard to conflict of law rules. Failure to enforce any right or provision under these Terms shall not be deemed a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between the parties regarding the use of the Service and supersede all prior agreements and understandings between the parties on the same subject matter.
Izy reserves the right, at its sole discretion, to amend or replace these Terms at any time. Where an amendment is material or entails a restriction of the User’s rights, Izy will provide notice at least 14 days before the revised Terms take effect. If the User continues to use the Service after the effective date, the revised Terms are deemed accepted. If the User does not accept the new Terms, further use of the Service must cease.
