Terms and conditions
for Izy App

These terms and conditions (“the Terms”) govern your use of the mobile application Izy App (“the Service”), provided by Izy AS (“Izy”, “us”, “we” or “our”). Further information about the Service is available at https://izy.no/.

Depending on which offerings are accessed through the Service, the terms and the processing of personal data may vary. If the terms applicable to a specific offering deviate from these Terms, this will be stated separately for that offering. The Privacy Policy is available here. By opening or using the Service, you accept these Terms.

Purpose

The Service is a tool for communication and service delivery in modern buildings. Through the Service, users are facilitated to receive information about the building and its facilities, receive offers for goods and services, and to place orders and make purchases from providers in the building and other associated providers, in connection with the building in which they are located. Please note that Izy is not itself a party to agreements entered into when the user places an order or makes a purchase, and that Izy is not responsible for the fulfilment of such agreements. Users may choose whether they wish to use location services. Where relevant, such services may contribute to certain features of the Service being more effective and precise.

Purchases

If you make a purchase of a product or service offered through the Service (“Purchase”), you are required to provide information necessary for completing the purchase, including payment details, billing address and delivery information. Such information will only be shared with third parties to the extent necessary to facilitate and complete the purchase, including payment processors and relevant suppliers.

For purchases made by guest users, certain technical data may be processed in order to enable the dispatch of a receipt. Further information on such processing is set out in the Privacy Policy.

Availability, Errors and Inaccuracies

Izy continuously updates the range of products and services made available through the Service. Products and services offered through the Service may be incorrectly priced, incorrectly described or unavailable, and delays may occur in the updating of information made available through the Service. Izy does not independently verify information transmitted through the Service by third parties, including suppliers, property managers and building owners.

Izy does not warrant the accuracy or completeness of such information, including prices, product images, specifications, availability and service offerings. Izy reserves the right at any time, and without prior notice, to amend or update information and to correct errors, inaccuracies or omissions.

User Account and Guest User

If your employer wishes you to pay for canteen meals through the Service and to receive other building-related information through the Service, Izy may have received your full name, email address and other necessary information from your employer in order to create a user account for you. If you do not activate your user account, the data will be deleted and not used for any other purpose.

The Service may also be used by persons who do not have their workplace in the building, either as registered users or guest users. When using the Service as a guest, certain technical data may be processed in order to enable purchases and the dispatch of a receipt. Further information on such processing is set out in the Privacy Policy.

Users are free to choose which offerings they wish to use through the Service. However, it is noted that not all features are available to guest users. Some employers may require that payment for canteen meals be made through the Service, in which case this functionality cannot be opted out of. Where an employer has negotiated discounted rates in the canteen for its employees, such rates may only be used by approved registered users for whom the employer provides a canteen subsidy.

Upon creating a user account, you are required to provide accurate and up-to-date information.

If you are registered as an employee of an employer in the building, it may be necessary for Izy to contact you. To ensure that the user account is linked to the correct person, and to prevent infringement of the rights of others, it is important that you use the email address provided by your employer, both when registering a user account and when contacting Izy.

You are responsible for safeguarding the password used to access the Service, as well as for all activities and actions carried out using the password. The password must not be disclosed to third parties. You are required to notify Izy immediately upon becoming aware of any security breach or unauthorised use of your account.

Security

Izy endeavours to maintain a safe and secure service environment for all users. However, Izy cannot guarantee complete security. The cooperation of users is of material importance to the security of the Service. When using the Service, users are at all times required to comply with these Terms, including any other guidelines made available by Izy to maintain the security of the Service.

If these Terms or other security-related guidelines are not complied with, Izy reserves the right to remove offensive or inappropriate content, terminate or restrict access to the user account, and to notify third parties, including law enforcement authorities, and disclose information relating to the account where this is deemed necessary. Such measures may be necessary to protect the safety of users and others, to investigate, remedy and enforce potential breaches of the Terms, and to detect and address matters relating to fraud or security.

In the event of malicious activity, or any other activity deviating from normal use, Izy must be notified without undue delay.

Intellectual Property

The Service, including its original content, features and functionality, is and shall remain the exclusive property of Izy, its licensors or other collaborating third parties. The Service and content made available through the Service are protected by copyright, trade mark rights and other intellectual property rules in Norway and internationally. The trade marks, signs and other intellectual property of Izy, its licensors and collaborating third parties may not be used in connection with products or services without the prior written consent of Izy.

Privacy

In order for Izy to deliver the Service and associated functionality, it is necessary to process certain personal data relating to users of the Service.

Izy acts in certain contexts as a data processor on behalf of employers, building owners and others who wish to make the Service available to users, as well as for businesses that offer products and services through the Service. In such cases, data processing agreements are entered into that govern the customer relationship and describe Izy’s processing of personal data on behalf of the data controller.

Izy also processes personal data for its own purposes, including in order to detect errors, improve and further develop the Service, and to prepare statistics and analyses. Where relevant, data may be aggregated and anonymised. For further information on Izy’s processing of personal data, including processing relating to registered users and guest users, reference is made to the Privacy Policy.

Termination

The User may discontinue use of the Izy App at any time by ceasing to use the application. The User may also elect to delete their user account directly within the App. Upon submission of a deletion request, the User shall receive a confirmation link by email. Once the User confirms the deletion, all personal data associated with the account shall be deleted within 30 days. Deletion of the user account shall result in the removal of the entire account, including the User's association with all buildings and other locations to which the account is linked. Should the User require assistance in connection with the deletion of their account, Izy may be contacted at info@izy.no. The processing and deletion of personal data shall be carried out in accordance with the applicable privacy policy and applicable law.

Izy reserves the right to terminate or restrict access to all or any part of the Izy App without prior notice and without liability.

Limitation of Liability

Under no circumstances shall Izy, its representatives or suppliers be liable for any direct or indirect loss, including loss of profit, data, use, goodwill or other intangible losses, or for claims from third parties, arising out of (i) your access to or use of, or inability to access or use, the Service, (ii) the conduct or content of third parties made available through the Service, (iii) content obtained from the Service, or (iv) unauthorised access to, use of or alteration of transmissions or content, regardless of whether Izy has been advised of the possibility of such damage, and even if the Service does not fulfil its essential purpose.

Izy’s aggregate liability in connection with the Service, breach of the Terms or negligence is limited to NOK 10,000.

Disclaimer

Use of the Service is at the user’s own risk. The Service is provided “as is” and “as available”. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or satisfactory quality.

Izy, its subsidiaries, affiliates, licensors and suppliers do not warrant that:

  • a) the Service will function without interruption, be secure or be available at any particular time or place;
  • b) any errors or defects will be corrected;
  • c) the Service is free of viruses or other harmful components; or
  • d) the results of using the Service will meet the user’s requirements.

Governing Law

These Terms are governed by and shall be construed in accordance with Norwegian law, without regard to its conflict of laws rules. Failure to enforce any right or provision under these Terms shall not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the parties regarding the use of the Service and supersede all prior agreements and understandings between the parties relating to the same subject matter.

Amendments

Izy reserves the right, at its sole discretion, to amend or replace these Terms at any time. If an amendment is material or results in a restriction of the user’s rights, Izy will provide notice thereof at least 14 days before the revised Terms take effect. If the user continues to use the Service after the effective date, the revised Terms shall be deemed accepted. If the user does not accept the new Terms, further use of the Service must cease.
