These terms and conditions ("terms", "terms and conditions") apply to your use of the web portal ("Izy Portal") offered by Izy AS ("Izy", "us", "we" or "our"). You can also find more information about Izy Portal here.
Depending on which offers via the Izy Portal you wish to use, terms and processing of personal data may vary. Where the terms for an offer deviate from the standard terms, this will be described separately below for each offer. The privacy policy can be found here. By opening or using the Izy Portal, you accept these terms.
The Izy Portal is a tool for communication, administration, and services in modern buildings. Through the Izy Portal, you may, in connection with the building in which you are located, obtain information about the building and its facilities, receive offers for goods or services, and make bookings and purchases from providers within the building and other affiliated providers. Please note that Izy is not a party to any agreement formed when you make a booking or purchase and is not responsible for the performance of such agreement. You may, at your own discretion, enable location-based services, which may render certain services within the Izy Portal more efficient and more precise; this is further specified where applicable.
If you wish to purchase a product or service offered via the Izy Portal ("Purchase"), you may be asked to provide certain information relevant to your purchase, including your credit card number, the expiration date of your card, billing address, and delivery information. Such information will only be shared with third parties, such as payment processors and suppliers, to facilitate the completion of the purchase.
We are continuously updating the range of products and services made available via the Izy Portal. The products or services available via the Izy Portal may be mispriced, inaccurately described, or unavailable, and we may experience delays in updating information conveyed via the Izy Portal.
We do not independently verify information that third parties, such as suppliers, property managers, or building owners, convey through the Izy Portal.
We do not warrant the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
If your employer wants you to pay for canteen food via the Izy Portal and receive other building-related information via the Izy Portal, we have received your full name and email address from your employer and other information necessary to create you as a user. If you do not activate a user account, we will delete this information and will not use it for any purpose.
You always have freedom of choice regarding which offerings via the Izy Portal you wish to use, but availability may vary by license type. If an employer has discounted rates in the canteen for their employees, these can only be used by approved, registered users for whom the employer pays a canteen contribution.
When you create a user account with us, you must provide information that is accurate and up-to-date.
If you register as a user employed by an employer in the building, we may need to contact you. To ensure that your account is linked personally to you and not to others, and to prevent infringement of others' rights, it is important that you use the email address provided by your employer when registering and when contacting us.
You are responsible for safeguarding the password you use to access the Izy Portal and for any activities or actions under your password. You must not disclose your password to any third party. You must notify us immediately if you become aware of any security breach or unauthorized use of your account.
The Izy Portal and its original content, features, and functionality are and will remain the exclusive property of Izy and its licensors or other cooperating third parties. The Izy Portal and content conveyed through it are protected by copyright, trademarks, and other laws in Norway and abroad. Our, our licensors', or cooperating third parties' trademarks, trade dress, and distinctiveness may not be used in connection with any product or service without Izy's prior written consent.
The Izy Portal may contain links to third-party websites, apps, or services that are not owned or controlled by Izy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Furthermore, you acknowledge and agree that Izy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read carefully the terms and conditions and privacy policies of any third-party websites or services that you visit.
To deliver the Izy Portal and its related functionalities, we must process certain personal data about our app users.
Izy acts in certain contexts as a data processor on behalf of employers, property owners, and others who wish us to add users to the Izy Portal, and for businesses that offer their products and services in the app. Where Izy acts as a data processor for such parties, data processing agreements are entered into that cover the customer relationship and describe our processing of personal data on the customer's behalf.
Izy also processes personal data for its own purposes, including the aggregation and anonymization of data to obtain insights that can help detect errors, improve and develop the Izy Portal, and compile statistics and analyses. For more information about our processing of personal data as a controller, see our privacy policy.
You may terminate your license to the Izy Portal by sending notice to info@izy.no. You can also terminate the license by ceasing to use the Izy Portal and/or the Izy App, after which your personal data will be deleted after 90 days. We may terminate your license to the whole or parts of the Izy Portal without notice or liability.
In no circumstances shall Izy, its representatives, directors, employees, affiliates, or suppliers be liable for any direct or indirect losses, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, or claims from third parties resulting from (i) your access to or use of, or inability to access or use, the Izy Portal; (ii) anyone's behavior or any third-party content conveyed through the Izy Portal; (iii) any content obtained from the Izy Portal; and (iv) unauthorized access to, use of, or alteration of transmissions or content, regardless of whether we have been informed of the possibility of such damage, or even if the Izy Portal does not fulfill its essential purpose.
The total liability of Izy related to the Izy Portal, any breach of these Terms, or negligence is limited to NOK 10,000.
Your use of the Izy Portal is at your own risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether expressed or implied, including, but not limited to, implied warranties of fitness for a particular purpose, non-infringement, or performance.
Izy, its subsidiaries, affiliates, licensors, and suppliers do not warrant that
a) the Izy Portal will function uninterrupted, securely, or be available at a particular time or location;
b) any errors or defects will be corrected;
c) the Izy Portal is free of viruses or other harmful components; or
d) the results of using the Izy Portal will meet your requirements.
We use reasonable efforts to make the Izy Portal a safe place for all users. However, we cannot guarantee this. By using the service, you agree to comply at all times with these Terms, including any other guidelines Izy makes available to maintain the security of the Izy Portal.
If you fail to comply with these Terms, we reserve the right to remove offensive content, terminate or restrict access to your account, and notify third parties, including law enforcement authorities, and provide such authorities with information related to your account. This step may be necessary to protect the security of our users and others, to investigate, address, and enforce potential breaches of the Terms, and to detect and resolve any concerns related to fraud or security.
In case of malicious activity, or other activity that deviates from the normal state, the User shall notify Izy immediately.
These Terms shall be governed by and construed in accordance with Norwegian law, without regard to its conflict-of-laws rules. Our failure to enforce any right or provision of these Terms will not be considered a waiver of such rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service and supersede all prior agreements between us regarding the service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material or reduces your rights, we will provide at least 14 days' notice before any new terms become effective. By continuing to access or use the Izy Portal after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.
